26-year-old suspect in councillor Mthembeni’s murder appears in court

Mr Mvelase reappeared before the court a short while ago

26-year-old Ayanda Siyanda Mshengu Mvelase appeared in the Estcourt Magistrate’s Court last Thursday in the murder case of Inkatha Freedom Party (IFP) proportional representation councillor Mthembeni Majola.

Said to be from Weenen, Mvelase faces two counts of murder and attempted murder.  The second count of murder came into play following the death of Mr Majola’s driver, Sthembiso ‘Sjava’ Mahlinza, on the night of August 16.

A jam-packed courtroom, with Mr Majola’s family at the very front, looked on as the suspect took the dock.  It is believed that the suspect was the hit-man behind Mr Majola and Mr Mahlinza’s death on that fatal night.

Magistrate Sam Mpungose explained to the suspect his right to paid or free legal representation. Opting for legal aid, Mr Mvelase informed his attorney that he had been severely assaulted by the South African Police Service (SAPS).

The State then argued that there was no visible indication of the suspect having been assaulted.  Another argument the State made was that Mr Mvelase be detained in the Westville holding cells, while his attorney insisted that a doctor’s appointment be arranged and that he be detained in Ladysmith.

The State consulted the investigating officer and announced that a doctor’s visit could be arranged.  The court revealed that the suspect had also appeared in Johannesburg for the possession of firearms.

He remains in custody in Ladysmith until his next court appearance.
