State hopes to deny bail for statutory rapist

"Young children are being targeted by rapists, and we need to show these criminals there are consequences."

In April this year, a young girl was allegedly raped by her maternal uncle.

The matter was only reported and brought to the attention of the police in May.

This week, the accused appeared at the Madadeni Magistrate’s Court facing charges of statutory rape.

According to evidence from witness statements and a J88 form, Investigating Officer Sergeant Khubekha hoped bail would be denied.

“The J88 showed us the girl was penetrated. From speaking to her we see how traumatised she is, and she is fearful that her uncle will come after her again should he be released on bail,” Sgt Khubekha told the court.

Furthermore, he believed being harsher on the accused would help put an end to the rising number of rape cases in the oSizweni area.

“Young children are being targeted by rapists, and we need to show these criminals there are consequences,” he said,

Sgt Khubheka said the accused also had a prior conviction and was of sound mind, staying within 10 kilometres from the victim’s home.

The court adjourned after the State’s motion to deny bail, as the judge deliberated over the case.
