Principal, Zithulele Majola and soldier, Thokozani Dlamini, were each granted R5000 bail during a formal bail application on April 13. The pair was implicated and arrested in March following the robbery of Pick ‘n Win in October last year.
The state granted them bail with the following conditions: the accused may not interfere with witnesses or the administration of justice. The accused are to report to their respective addresses in Uitval and Ezakheni.
The Prosecutor, Mr Jiyane, objected to granting Mr Dlamini bail as he was also accused of wounding and shooting the security guard at Pick n Win. Prosecutor Jiyane further stated that ‘Dlamini also had previous charges. He also has a pending case for robbery in Newcastle and was out on bail during the commencement of the Pick ‘n Win robbery, and for this reason should he not be granted bail’. However, the decision for bail was granted after their Attorneys, Rajesh Ramkhelawan and Melokuhle Shabangu argued that the pair had personal circumstances which had to be considered.
Practicing Attorney, Mr Shabangu, highlighted that his client, Mr Dlamini was married and had two children dependent on him. Mr Shabangu further highlighted that, “the accused is receiving dialysis and this personal circumstance should be considered.”
Attorney Mr Ramkhelawan also argued that his client, Mr Majola, ‘was also not a flight risk as he is an upstanding member of society, has no previous convictions, has strong family ties and has a great sum of personal assets that would weigh heavily in his defence ‘.
After an extensive plea from both attorneys, Magistrate Khumalo granted the two accused bail and instructed them to return to the Dundee Magistrate’s Court on April 24 for a regional court date.
