Justice for rapist 11 years after brutal attack

The suspect followed the victim after she had left the party before accosting her and forcing her to his house where he repeatedly raped her before dropping her off the next morning.

Eleven years after she was raped, a woman who was teenager at the time, has finally seen the justice meted out to the man who attacked her following a Christmas party in Osizweni in December 2012.

The Madadeni Regional Court has sentenced the 34-year-old man, to life imprisonment, for the rape after the teenager had gone to a party with her older sister and her sister’s friend.

The Court heard that at some point, her sister left with a male companion (the accused’s friend) and sometime after, her sister’s friends left with another male companion, leaving her alone with strangers.

The accused, who was also at the party, followed the girl when she decided to walk home. At some point, he accosted her and dragged her to his house.

There he raped her and he raped her again the following morning. He then took her to his friend’s house where her sister had spent the night.

The girls went home, and the complainant did not report to her sister, because she was angry at her for abandoning her the previous night. A day later, the complainant told her sister what had happened, and they reported the incident to the police.

The complainant was taken to the Madadeni Thuthuzela Care Centre, where she received medical and psycho-social assistance. The man was arrested a month later.

In court, Regional Court Prosecutor, Don Motha, led the testimonies of the complainant, her sister and the doctor who did the medical examination. The victim told the court that the offence has traumatised her.

Natasha Ramkisson-Kara, NPA regional spokesperson, explained that the delay in finalising the matter was a result of the accused changing his legal counsel on several occasions.

Despite this, the State Prosecutor fought for the matter to proceed, eventually leading to the finalisation of the matter.

This case emanates from the backlog cases at Madadeni where the NPA is making concerted efforts to alleviate the backlog.

“The NPA welcomes this successful prosecution, and we commend the work done by both the prosecution and the investigation team.”
