A father accused of raping his 38-year old epileptic daughter repeatedly in the two years he allegedly held her captive in their home, appeared in the Dannhauser Magistrate’s Court on Thursday, January 19, for a formal bail application.

The man, who resides alone with his alleged victim in an area called Dorset just outside the town of Dannhauser, was taken into custody on October 30 and charged with rape and assault with the intention of causing grievous bodily harm.

Describing the incident which led to the man’s arrest, investigating officer, Constable Nkululeko Mbethe, told the court that on the afternoon of October 27, the man went into his daughter’s room, grabbed her and attempted to undress her.

Her efforts to fight back resulted in her sustaining a head injury, according to Mbethe.

“The accused went to the neighbouring house to request help for his daughter’s injury. The neighbours called for an ambulance and when they didn’t receive any assistance, they hired a private vehicle to transport her to the Dundee Hospital,” said the investigating officer.

“She was admitted that day and discharged the next day. When her sister came to fetch her from the hospital, the victim finally had a chance to confide in someone about what happened. She informed her sister that their father had been trying to rape her when she sustained the head injury, and that he had been raping her since 2020. Her sister took her directly to the police station where she opened a case.”

According to the investigating officer, the J88 form, which is used to record medical evidence, indicates that the victim sustained various bruises and injuries which are consistent with somebody who has been sexually assaulted.

Asked why the woman had not reported the rape previously, the investigating officer explained that her father refused to allow her out of the house to visit the neighbours or even her own siblings.

Among the reasons that the accused provided to the court to be released on bail is his ill-health. He informed the court that he suffers from arthritis, high blood pressure and diabetes.

He further stated that he did not enjoy the food in prison and that he felt that the ‘unhealthy meals’ were contributing to his ill-health.
