Momberg says k-word used out of anger and fear, not from a hateful heart

JOBURG – The k-word estate agent has told the court that prosecutor seems to be personally offended by her use of the k-word.

Vicki Momberg has told the Randburg Magistrates’ Court that her use of the k-word did not come from a hateful heart.

“There were a lot of emotions involved. The words came out of a situation of trauma, fear and anger but definitely not from a hateful heart,” she said during her cross-examination in mitigation for sentencing that is currently underway.

Momberg was found guilty on four counts of crimen injuria after she was caught on video last year uttering racist remarks to black police officers at the scene where she had claimed to have been a smash-and-grab victim. Momberg also used offensive language during a 10111 when she was trying to get assistance.

During her cross-examination, Momberg told the court that she felt victimised by the state prosecutor, Yusuf Baba. Momberg said there were numerous situations that she saw as victimisation by Baba. She accused the prosecutor of not looking at the facts leading up to her outburst that led her use of the k-word.

It also emerged that Momberg has laid a complaint with the senior public prosecutor of the Randburg Magistrates’ Court, with her dissatisfaction of how Baba is handling her case.

She also told the court that from her own observation, Baba seemed to be deeply offended by her use of the k-word.

Baba, however, told Momberg that she seemed to have a problem with everyone.

The prosecutor pointed out that she had changed legal representatives from the start of her case. In response, she said there were grounds on which she had to terminate relationships with those lawyers.

Baba also brought up the issue of how Momberg had a problem with the media.

Momberg responded that she specifically had a problem with TV news channel, ENCA. She said that during her trial they were allegedly reporting inaccurate information. She told the court that she intended to take legal action against them.

The pre-sentencing proceedings continue.
