UPDATE: KDM off the hook

The KZN public protector’s office has resolved its issues with the KwaDukuza municipality after accusing it of “unlawful and disrespectful conduct” when KDM apparently ignored a summons to answer to housing-related issues affecting KwaDukuza residents.

In a four-page letter to the provincial co-operative governance and traditional affairs (COGTA) MEC Nomusa Dube-Ncube on June 23, KZN public protector Advocate Mlandeli Nkosi asked the MEC to intervene in getting municipal manager Nhlanhla Mdakane and other officials to cooperate with his investigation.

He was looking into allegations of maladministration and prejudice in the allocation of RDP houses, that KDM did not follow the due process when expropriating certain properties and of undue delay in providing a man with an RDP house.

In the angry letter, Nkosi accused Mdakane and his officials of not performing their functions properly, not attending meetings and blatantly ignoring summonses to subpoena hearings on May 10 and June 22 this year.

However, Advocate Nkosi reported recently that there had been a successful interaction between her office and KDM three weeks ago.

She said the municipality had responded to her office within the time-frames agreed to at a meeting.

“This has resulted in the finalisation of all public protector investigations that were pending.

All undertakings made by the KDM municipal manager, and his senior management team, have been duly, and timeously, complied with.”
