SCA dismisses Gigaba’s appeal over constitutional breach ruling

The Supreme Court of Appeal (SCA) has reportedly dismissed an application by Home Affairs Minister Malusi Gigaba to appeal a high court ruling that found he had violated the constitution in connection with the billionaire Oppenheimer family’s private immigration terminal at OR Tambo International Airport.

Gigaba had appealed a damning Pretoria High Court ruling in December that found that his claim, that he had never given approval to the Oppenheimers’ Fireblade Aviation to establish a VIP facility at the airport during a meeting in January 2016, was false.

Judge Tuchten found that Gigaba had violated the constitution by lying under oath and denied him the right to appeal an October 2017 judgment by the same court that ruled in favour of Fireblade Aviation.

In handing down judgment this morning, Judge Malcolm Wallis said the court did not think the minister’s arguments had any reasonable prospects of success, Jacaranda News reports.
