High court approves KZN sentence

Two High Court in Pietermaritzburg judges on Tuesday approved the 25-year prison term previously handed to a man convicted of kidnapping and raping a 13-year-old boy.

In endorsing the sentence imposed by the Dundee Regional Court last year, Judge Esther Steyn said the youth would carry the psychological scars long after Bongani Mthombeni, 22, was released from custody.

Mthombeni kidnapped the youth, raped him five times overnight, and released him in a forest, where he became lost.

Steyn said the kidnap and rapes had a severe psychological impact on the youth’s father, who searched for him with hunting dogs from early in the morning. He found the traumatised boy and alerted police.

Mthombeni was tried and sentenced by regional magistrate TCL Colditz in July 2013.

Steyn said Mthombeni not only impaired the boy’s dignity by kidnapping and raping him, but added further insult by giving him R27 after the rape. Judge D Pillay concurred.
