Man sentenced to 15 years for murder of eMalahleni specialised police officer
One of three accused has been sentenced for the 2021 murder of Witbank Tactical Response Team officer Sergeant Joseph Kutu.
A major breakthrough in a long-running murder investigation was achieved this week when the Mpumalanga High Court, sitting in Middelburg, sentenced one of the accused in the 2021 killing of Witbank Tactical Response Team officer Sergeant Joseph Kutu.
The sentence was delivered this week in the Mpumalanga High Court sitting in Middelburg, reports the Middelburg Observer.
The case was driven to this point by extensive work from the Middelburg-based Hawks’ Serious Organised Crime Investigation unit.
Sergeant Kutu, who was 43 at the time, was killed in July 2021 after returning home from deployment. According to evidence before the court, he arrived at his Vosman home to find that his wife was not there. She later returned and parked the couple’s vehicle in the garage.
The court heard that she allegedly entered the house with two men who opened fire on her husband. Kutu was rushed to hospital, where he died shortly after the shooting.
The case was transferred to the Hawks’ Middelburg-based Serious Organised Crime Investigation unit, whose work led to the arrest of three suspects, including Kutu’s wife. Two firearms, a handgun and a rifle, were also recovered during the investigation.
All three accused were initially denied bail, although Kutu’s wife was later released on R10 000 bail following an appeal.
Proceedings were set to continue on Monday, but were postponed to yesterday due to issues with legal representation. Yesterday, accused Xolani Ndabezitha (29) pleaded guilty and was sentenced to 15 years in prison.
His co-accused, Bonginkosi Langa, has since indicated that he also intends to plead guilty, and his matter has been postponed to Wednesday, February 18.
The third accused, Sgt Kutu’s wife, is expected to appear in court on January 17, 2028.
Major General Nico Gerber, Provincial Head of the Hawks in Mpumalanga, welcomed the sentencing and said the unit remains committed to securing justice for the slain officer.
“One life lost is too many, especially a father and dedicated member who served this country. We are pleased that one of the accused has been sentenced, and we believe justice will be served in the remaining cases,” he said.
