Another win for MK Party after winning trademark battle

The ANC argued the name and logo of the uMkhonto weSizwe (MK Party) will confuse voters in the upcoming elections.

The ANC suffered another legal blow this morning when the Durban High Court dismissed its application for the uMkhonto weSizwe (MK Party) to be barred from using its current name, which the ruling party claims is its intellectual property given that the ANC’s disbanded liberation struggle armed wing went by the same name.

However, the court, which is yet to give reasons for its order, dismissed the ANC’s application with costs.

The MK party is one of the political parties that will contest the upcoming May 29 general elections.

The ruling party had argued in court papers, that should the MK Party be allowed to use its current name and logo, voters were likely to confuse the new political party with the ANC.
