Magistrate Majaji Ngobeni sentenced Kenneth Brits to a fine or eight months in prison, of which three months was suspended on a condition that he is not found guilty of a similar offence.
Conducting his own defense, Brits tried to explain to Ngobeni that he accelerated to try to avoid a situation which could result in an accident. He told the court that he was involved in an accident in April this year.
Brits version was brushed off by the traffic officer who arrested him on October 30, Inspector Victor Sifundza who explained that there were only two vehicles in front of Brits when he recklessly overtook.

He added that he and his colleague asked Brits why he was speeding and he told them that he had not seen any speed-limit signs or traffic cops on the road. “While we were busy arresting him a woman driving a Mahindra approached us and thanked us for arresting the accused because he was driving recklessly on the road,” said Sifundza.
The state prosecutor, Oupa Ndlovu asked the magistrate to impose a sentence that would serve as a lesson to other motorists. He said Brits was impatient and the fact that there were no signs indicating the presence of law enforcers should not be a concern as all road users must comply with the rules at all time.

“The courts deal with a number of inquests in which people are killed on the road by motorists who drive at a high speed and under the influence of alcohol. Such offences are prevalent nationwide. He was fortunate that there was no accident,” Ndlovu said.
