Mdluli and Khoza’s legal representatives seemed to agree with each other from the very start when they told the court that they were not ready to proceed with the proceedings of the bail application because they need to know the charges against their clients. They also need access to the charge sheet which they don’t know if it was correctly completed or not and need reasons why the state would oppose bail against their clients.

The state advocate, Ms Vivian Sebatjane then explained that the three intentionally conspired to commit the offence between December 26, 2016 and January 23, 2017 and that they eventually assaulted the late Mdluli, suffocated him and strangulated him with a rope at his house on January 23.

She added that the reasons why the state opposes bail against the three will be explained later during the bail application.

The defence team maintained that they need access to the police docket and be given reasons by the state why they oppose bail before they should make bail application. These debates continued for rest of their court appearance on Wednesday.
The bail application was finally postponed to continue on May 12. The three are still in custody.
