R5000 fine for assaulting a CPF member

A 21-year-old man was found guilty of assaulting a member of a Community Policing Forum (CPF), Ms Zodwa Nkosi with a stone was recently sentenced to 90 days' imprisonment or a fine of R5 000.

MATSULU – Mr Jabulani Ngwenya received his sentence at the Matsulu Periodical Court on March 3.

The court heard that in 2008, Ngwenya attacked the CPF member with a stone while she was walking home around 20:00. The complainant sustained serious head injuries. Conducting his own defence, Ngwenya said he had been defending himself from the CPF member who sprayed him with a spray gun. He also accused the complainant of a vendetta against his mother, as this member of the CPF exposed some of her wrongdoings.

While passing judgement, the magistrate highlighted that Ngwenya contradicted himself in some of the evidence in court. “It is clear that you fabricated the story and it showed that you ended up fighting your mother’s battles against the complainant. You are, therefore, found guilty of Assault GBH.”

She added that Ngwenya did not show any sign of remorse for his behaviour. According to the magistrate, the sentence will serve as a deterrent to all who would be accused for the same offence, as “CPF structures are meant to help police in fighting crime in the community”.
