Court orders state to sort its house, struck theft case off the roll

JOBURG – Docket fails to make its way to court for the second time, magistrate struck case off the roll.

 

The Midrand Magistrates’ Court has ordered the state to get its house in order and struck a theft case off its roll.

This after state prosecutor Charlene Khosa asked for a postponement in a case against a woman accused of stealing from her employers.

Khosa told the court that the docket was not in court. She pointed out that she did send a request to the police station for the docket to be sent in but it did not arrive.

She told the court that the non-arrival of the docket might have to do with the fact that the investigating officer was working night shift.

The defence attorney objected to the postponement and told the court that the postponements were prejudicial to the accused’s right to a speedy trial. The attorney pointed out that even at the previous appearance, the docket was not available and the case was postponed.

Magistrate Lieland Poonsamy agreed with the defence and told the state to get its house in order. He struck the case off the court roll and said the state can subpoena the accused once they have all their ducks in a row.
