Driver sentenced for Easter accident that killed delivery driver

The court handed down a suspended sentence for the driver responsible for Motheo Madihlaba's death.

Jonas Moedigi Sebati was sentenced today for his role in the Easter 2022 death of delivery driver Motheo Madihlaba after pleading guilty to charges of culpable homicide and driving under the influence.

Madihlaba was struck and killed by Sebati’s bakkie after Sebati overtook two vehicles into oncoming traffic over a solid traffic line, resulting in the fatal collision.

Madihlaba started delivery runs for #Braai #Pizza only two weeks before his death.

Sebati was allowed to leave the police station without facing formal charges following his arrest at the accident scene.
Upon his release, Sebati was told to report to the police station in April 2023.

He was eventually charged with culpable homicide, as well as operating a vehicle under the influence of alcohol.

Sebati pleaded guilty to both charges during an earlier court appearance.

Madihlaba’s bereaved family was again supported by the AfriForum’s private prosecuting unit in court.

AfriForum took the matter on review after Motheo’s mother, Granny Madihlaba, requested their intervention.
Sebati was sentenced to eight years imprisonment, wholly suspended for five years, on the count of culpable homicide.

He was ordered to pay a fine of R4 000 or serve one year in jail on the charge of driving under the influence.
