Hawks members sent to jail for fraud

The former commander of the Anti-Corruption Unit as well as a member of Organised Crime in Middelburg, will be facing jail time for fraud.

Richard Lekotswane Nkwanyana (48) and Peter Mathekanyana Molapo (58) were found guilty of submitting false subsistence and travel claims in 2006. The pair were booked into a guest house for two days but only stayed for one. They then manipulated the information on the invoice and on the computer system, claiming R850 per person.

Advocate Patrick Nkuna for the state, managed to prove that the invoices were forged.

Advocate Nkuna told the court that it should be seen as an aggravating factor that the fraud was committed by a person of stature in a position of responsibility.

Nkwanyana received a five-year direct prison sentence on two counts of fraud and one count of forgery and uttering. Molapo received a six-year imprisonment sentence on two counts of fraud and two of forgery and uttering.

Nkwanyana has another pending case for theft and defeating the ends of justice in the Nelspruit Regional Court.

National Prosecuting Authority spokesperson, Monica Nyuswa, said that the NPA welcomes the conviction and sentence and hopes that it will deter government employees from committing similar crimes.
