Sheriff returns to seize properties at FTLM

BURGERSFORT – Provision of services in Fetakgomo Tubatse Local Municipality (FTLM) was hampered when the Sheriff seized moving assets last Wednesday. Three tipper trucks, a TLB and a grader were seized by Elias Mohlala and his team.

The vehicles were confiscated in full view of members of the public at the former municipal buildings.

“There is a court order of about R1,2 million. FTLM failed to pay its debts to our client, who is an attorney. It ranges from way back in 2017. The municipality lost its case at the Polokwane High Court on July 30 and that is the reason why we are here to seize its assets,” said the Sheriff.

He said he also recently forwarded a summons to the municipality after another client alleged he was owed R4 million by FTLM.

Plans by municipal officials to stop Mohlala were unsuccessful as they failed in their attempts to settle the debt. Insiders working at the municipality confirmed to Steelburger/Lydenburg News that all the vehicles were returned on Friday morning after FTLM succeeded in making the payment on Thursday morning.

The newspaper made contact with its communications team, but at the time of going to press, there was no response.

It was not the first time the Sheriff attached FTLM’s property. In 2017, Mphaphuli Consulting obtained a warrant of execution after the municipality failed to pay R40 million that was owed to the company. Mphaphuli had to attach two of the municipality’s investment accounts before it was paid.

In 2016, Munsoft Pty (LTD) issued a warrant for the attachment of three graders and four trucks. FTLM owed Munsoft R1 824 912 for services rendered in June 2013.

In February, Mphaphuli Consulting filed a claim of R5 000 million in the Polokwane High Court after the municipality allegedly canceled Operation Mabone.
