Masoyi father denied bail for alleged rape of his 13 year-old daughter

Sindane testified that the man had raped his daughter on previous occasions, before the most-recent incident on May 29.

A 37-year-old man who was arrested in connection with the rape of his 13-year-old daughter was denied bail.

The investigating officer, Sgt Nkosinathi Sindane, as well as the state prosecutor, opposed the accused’s bail application on July 1 in the KaBokweni Magistrate’s Court.

“The victim was raped by the accused on December 4 last year and was warned not to tell anyone. He again raped her on December 24, when he told the her that she ‘reminds him of her mother’. It happened again earlier this year as well as on May 29,” testified Sindane.

He said on May 29, the child was visiting her father at his home in the KaMphatseni area when she was held against a fence and raped by the accused, who ordered her not to tell anyone.

“She did not tell anyone. Only a few days later, her aunt and her stepmother noticed that she was bleeding from her genitals. That was when she informed them about the incident.

“Her stepmother warned her not to tell anyone about the alleged rape. However, her aunt called the victim’s biological mother to inform her of what had happened and the mother opened
the case.”

It was revealed during Sindane’s testimony that the man had other previous criminal offences, including a rape incident in 2016, as well as a case of assault.

Sindane added that that the accused was not honest about being a first-time offender, as he testified through his defence lawyer, Adv Senzo Singwane.

The accused also told his lawyer that he had only four children, but told the investigating officers he had seven.
Magistrate TL Maphophe denied the accused bail and postponed the matter to August 13 for further investigation.
