Domestic workers can now be registered with compensation fund

The Department of Employment and Labour (DEL) has promulgated the process in terms of which employers of domestic workers can register for purposes of the Compensation for Occupational Injury and Diseases Act (COIDA).

This is in keeping with the Constitutional Court judgement that determined that the exclusion of domestic workers from the scope of the Act was unconstitutional.

In terms of the gazette, employers of domestic workers must mail the following documents in order to register a domestic worker:

• A completed application for the registration of the domestic worker-employer (CF-1E Form)

• A copy of the identification document, passport, or work permit of the employer;

• Proof of the employer’s residential address;

• A copy of the identification, passport, or work permit of the employee; and

• A copy of the employment contract.

Applications for registration can be mailed to RegistrationCF@labour.gov.za or CFCallcentre@labour. gov.za According to the National Employers Association of South Africa (NEASA), employers of domestic workers are also required to submit return of earnings annually between 1 April and 31 May.

This may be done by registering online. Employers may submit claims for occupational injury either manually at any of the DEL centres or by registering online.

“Although this amendment, which protects domestic employees, is probably long overdue, we fear that the, completely dysfunctional, Compensation Fund will also be a severe disappointment and cause of frustration for domestic employees, as is the case with all other employees,” said NEASA in a statement.
