Know your fines

The fine you get in the post, according to Krugersdorp's Traffic Department, is legal.

With many fines recently being retracted by Johannesburg Metropolitan Police Department, Krugersdorpers are unsure whether fines received by post are legal.

William Nchefu, Head of Mogale City’s Traffic Department said fines sent by post in Mogale City are legal.

“We do not issue Aarto (Administrative Adjudication of Road Traffic Offences) fines like Tshwane and Joburg.

“Residents of these metros receive fines by registered post, and they need to pick up their fines at the post office and sign as evidence of receipt,” he said.

Unlike the Aarto Act, the Criminal Procedure Act does not have specific timelines in which processes must be followed. It also holds that all traffic offences are criminal offences.

According to Section 56 of the Criminal Procedure Act, fines sent by post in Krugersdorp and the greater Mogale City area are legal.

If can expect to pay:

• R500 if you do not have your driver’s licence with you while driving

• R3 000 to R5 000 if you drive without having a driver’s licence

If you drive 31 kilometres per hour over the speed limit (driving 91km/h in a 60km/h zone for example), you will receive a different kind of fine in the post.

“If NAG (no admission of guilt) appears on your fine, you can be fined only a certain amount by a magistrate at the Krugersdorp Magistrates’ Court,” said Nchefu.

“You can by expected to pay anything from R100 to R40 000.”
