The horrific accident involving the taxi Sithole was driving and a bakkie happened at the intersection of Barry Marais and Old Heidelberg roads (R103), just outside Vosloorus on February 7, last year.
One of the accident victims, Agnes Khumalo, died at the scene of the crash. Meanwhile Thabo Phetswan, David Nkambule, Kwangwayini Modiga died on February 21, 2016, in hospital. The fifth deceased, Bonga Mangele, died in hospital on February 27, 2016.
Sithole pleaded guilty on April 25 and was later found guilty on five counts of culpable homicide with motor vehicle before he was sentenced last month.
All the counts were taken together for the purpose of sentencing and was sentenced to 10 years imprisonment, of which five were suspended for five years.
Magistrate Sijren Harichand presided and prosecutor Nkosazana Tyeku represented the state.
The accused applied for leave to appeal on July 5, and it was denied.
It was also reported that several other passengers suffered serious injuries in the collision.
At the time, it was reported that the taxi was from Vosloorus and that it was en route to Dunswart station in Boksburg, while the bakkie was driving towards Heidelberg on the R103.
