Procedures to claim damages from the municipality

Have you suffered damage or loss as a result of negligence by the municipality? Here’s how you can claim for damages.

Ekurhuleni residents may lodge claims against the Ekurhuleni Metropolitan Municipality (EMM) for loss or damage to one’s property as a result of wrongdoing by EMM.

Ekurhuleni spokesperson, Themba Gadebe, released a statement on the procedure a resident should follow if they want to submit a claim.

In order to apply, claimants must complete a prescribed claim form and provide proof that the municipality’s negligence resulted in the loss or damage to the claimant’s property. Prospective claimants should keep in mind that the proof provided should indicate that any losses suffered are due to an act of neglect or omission on the part of EMM or its employees.

Claims must be appraised or assessed and a monetary value must accompany the claim to proof that the loss is the same as the amount claimed. Quotes, invoices and photographic evidence should also be submitted with the claim form.

The submitted information and a report from the EMM department responsible for the loss or damage, will be given to the council’s insurers who will make a ruling on the claim.

The submission of a claim does not mean that the claim will be settled. If accepted, the claimant will receive an offer or agreement of loss that needs to be signed and returned to the municipality’s insurance section for processing. If the claim is rejected, the claimant will be notified in writing with reasons supplied for the rejection. Applicants not in agreement with a ruling made on their claim may appeal the ruling in writing.

Payments for successful claims will be made through the normal expenditure payment processing system. The process may take up to 30 days depending on the authorizations that need to be obtained.
