PUBLIC NOTICE: Preparation and Adoption of Land Use Management Scheme for eThekwini

Several amendments have been proposed to the current Land Use Management System of the eThekwini Municipality.

The most important component to facilitate development on properties is proper land use management and therefore the need to provide a balance of land uses such as residential, office, commercial, educational, and recreational which remains integral to the sustainability of the eThekwini area.

Municipalities all have the responsibility of Land Use Management (LUM) within areas of their jurisdiction and the primary instrument through which they achieve this is the Land Use Scheme.

The Spatial Planning and Land Use Management Act no. 16 of 2013 (SPLUMA), stipulates that all municipalities must prepare, adopt and implement a municipality wide Land Use Management Scheme within 5 years of its enactment.

This is further reiterated in the eThekwini Municipality: Planning and Land Use Management Bylaw 2016 (EMPLUMB).

In consideration of the above and as there are still large parts of the eThekwini Municipal area that have not had the benefit of guidance from a land use and activity perspective, a Municipal area wide Land Use Scheme addresses this by gathering information from all different sectors of the municipality in order to produce and provide the Traditional Leaders and other stakeholders within the municipal area with proper information and data relating to the current activities in order for all stakeholders to make more informed decisions on development within all areas of the municipality.

In pursuance of the above then, and in terms of Chapter 5, Clause 24 of the SPLUMA and Chapter 6, Clause 14 of EMPLUMB, the following amendments to the current Land Use Management System of the eThekwini Municipality are proposed for adoption;

1. The introduction of two base Land Use Management Scheme (LUMS) zones, over areas outside of an adopted land use scheme.

2. Amendment of Section 7 (Development Facilitation Tables) of the Inner West, Outer West, Central, South and North Land Use Planning Schemes, by the inclusion of new Development Facilitation Tables, outlining the LUMS guiding parameters of the two base Land Use Management Scheme (LUMS) zones.

3. Amendment of Section 1 (General) and Section 2 (Land Use and General Definitions) of the Inner West, Outer West, Central, South and North Land Use Planning Schemes, by the inclusion of certain General provisions and Land Use/General definitions, to accommodate development within Traditional Authority Areas.

The details of the abovementioned proposal are documented and will be available for viewing at each of the regional offices, from the 25 February 2020 until 26 May 2020 during 08h00 to 16h00 Monday to Friday. Please note that the comments period will close 16h00 on 26 May 2020.
