Malawian accused of Leighton Agg’s murder makes second court appearance

The 21-year-old Malawian suspect used the services of a translator to provide information requested from him by Magistrate Gwendolyn.

A MALAWIAN man made his second appearance in the Pinetown Magistrate’s Court on Wednesday in connection with the death of Hillcrest man, Leighton Agg.

The man, who is facing charges of housebreaking with intent to rob and murder, is so far the only person arrested, although police say more arrests are expected. 

He is being kept in custody at Hillcrest SAPS.

The accused first appeared on Friday, 9 October.

He was arrested on the same night Agg’s stabbed body had been found near Pietermaritzburg.

On 14 October, the 21-year-old accused was provided with the services of a translator and through him provided a residential address in Westville where he said he works, as a casual worker, in the garden for the owner of the property.

The matter of the accused’s leave to remain in South Africa was also discussed as his residence permit had, according to the legal aid representative appearing for the accused, expired in August.

Missing

According to reports, Agg went to Hillcrest for an appointment on 30 September and was last seen driving his white Bantam bakkie in Winston Park at 5.44pm.

His vehicle was found abandoned in the Alexandra Road policing precinct, which shifted the search to Pietermaritzburg. 

He was reported missing at Hillcrest SAPS.

 

Charge sheet

According to the charge sheet the man is accused of murdering Agg by “assaulting him using a hammer and electric cord and also stabbing him with a knife.”

The charge sheet pertaining to the robbery and housebreaking describes items allegedly stolen, which include a laptop, two cellphones, Agg’s wallet with bank cards and an undisclosed amount of money as well as Agg’s vehicle.

In the remand request following his first appearance on 9 October it is indicated that the investigating office intends to oppose bail.

The accused was not asked to plea and the case was remanded for further investigation until 20 October.
