Think ahead – get your will drafted for free

Next week is National Wills Week, an ideal opportunity to get a professional and legal will drafted, at no cost.

DO you have a will? When last have you updated your will? Who will inherit your property and other assets when you die?

These may not be pleasant questions to think about, but they are absolutely crucial. Next week is National Wills Week, an annual event that encourages members of the public to draw up wills for free.

A number of attorneys will participate from Monday, 17 to Friday, 21 September; private attorneys, Legal Aid South Africa attorneys, attorneys affiliated with the Law Society of South Africa, the South African Women Lawyers Association, ProBono.Org, law clinics and many others.

Why are wills so important?

All people should have a will in place to ensure that the distribution of their assets at death is done according to their desires. This legal document expands on the wishes put forward by the testator (the person who has drawn up a will) by meeting the guidelines and directions outlined, which has also been signed by witnesses.

Wills differ depending on the assets of the testator. Your ID number and details of immovable and movable property are listed, as well as the details of the beneficiaries you are leaving these assets to. Make sure you have all the necessary documents and information with you when visiting a participating National Wills Week attorney, such as ID documents and a list of what you own, and who you wish to leave these assets to.

“National Wills Week seeks to raise awareness among the public on the importance of drafting a will. It is important to have a legal expert assist in drafting your will as their knowledge and expertise will ensure that the will is valid, meets all legal requirements and that your assets are efficiently administered,” said Bongani Mahlangu, Legal Aid SA KZN Provincial Communication practitioner

“We encourage people to visit our office at 1 Church Lane, Pinetown or call us on 031 719 2700 for assistance with the drafting of their wills,” said Mahlangu.
