Managers, technical specialist charged in Shongweni Landfill’s criminal case

The NPA's criminal case against EnviroServ was postponed to 17 November.

DURING the National Prosecution Authority’s (Green Scorpions) criminal case against EnviroServ and its CEO, Dean Thompson, additional accused were added to the original charge sheet, at the Durban Magistrate’s Court today, 17 August.

The senior state advocate, Yuri Gangai, requested EnviroServ employees, Esmé Gombault (group technical director), Clive Kidd (coastal manager) and Johan Schoonraad (group technical specialist) be added to the accused list, which was granted by Honourable Justice Magistrate Simphiwe Hlope.

The first accused is EnviroServ as a company, second accused is Dean Thomspon (chief executive officer), Esmé Gombault as third accused, Clive Kidd as fourth accused and Johann Schoonraad as fifth accused face charges of contravening the National Environmental Air Quality Act and National Environmental Waste Act.

Magistrate Simphiwe Hlope postponed the case until 17 November so that the supporting documents can be reviewed by both the state and defence.

EnviroServ had bussed in employees singing their praises. After the postponement of the case, they protested outside the court waving professionally-printed placards claiming they have worked at EnviroServ for the last nine to 15 years and that they have never suffered any ill health, toxic odour or medical condition.

The situation became hostile when the EnviroServ employees claimed that the Upper Highway NPO members were racist. Some of the chants included “Down with the white people”, “Down with the oppressors”.
