Department of Labour expresses concern over illegal recruitment practices

The department said it strives for a labour market that is conducive to investment, economic growth and employment creation.

THE Department of Employment and Labour (DEL) has expressed its concern with regards to illegal recruitment practices in the labour market.

The department’s spokesperson, Petunia Lessing, said some employers have employ undocumented, foreign nationals, and are also subjected to inferior labour standards.

“Some employers do not declare them in their books and do not cover them in terms of existing social protection measures, such as the UIF, the Pension Fund and the Compensation Fund.

“These practices are illegal, they are unacceptable and it is something that is pre-occupying us daily in the Department of Employment and Labour,” Lessing said.

The department reiterated that the rights of all workers are enshrined in the Constitution and all labour laws accord the same standards and rights to citizens, as well as foreign nationals employed in the country.

“The department has identified a gap in the general understanding and knowledge of services and programmes it provides,” Lessing said.

The Department also has other bodies, such as the CCMA, that play a role in terms of mediation and arbitration of disputes that arise, as well as the Labour Court.
