Application for urgent interdict against Angelo move struck off urgent roll

The Johannesburg High Court delivered a verbal judgement that the application was too voluminous and technical to be considered on an urgent basis.

The fight to stop the relocation of the Boksburg-based Angelo informal settlement to Germiston went to the Johannesburg High Court, during the week.

The application for an urgent interdict to prohibit the relocation of residents from the Angelo informal settlement was heard, last Tuesday, with judgement on the matter being delivered on Friday morning.

Lynette Nance-Kivell from Nance-Kivell Attorneys, a civil and litigation expert and a Marlands resident, argued the matter for the urgent interdict against the metro on behalf of the residents.

Acting Judge Shangisa delivered a verbal judgement.

He considered the application to be too voluminous and technical for him to consider on an urgent basis.

In his opinion the application lacked the requirement of “extreme circumstances” to warrant the matter to be dealt with on an urgent basis.

The matter was thus struck off the urgent roll.

In light of the judgement, the legal team is considering their next course of action.

While the application was being heard in court, last Tuesday, residents from the Angelo informal settlement took to the streets and marched to the Boksburg Civic Centre in protest against the move.
