Bid to nullify city manager’s contract fails

Metro’s city manager to continue his duties.

An application to invalidate the Ekurhuleni city manager’s employment contract failed in the South Gauteng High Court on Thursday.

The court declined to declare the extension of the city manager’s contract unlawful and invalid.

It also declined to review and set aside the metro’s resolution extending the contract.

The matter is being referred to the Gauteng MEC for Housing and Local Government for consideration within 10 days from date of judgment.

The effect of the court order is that the resolution of council of September, 27, 2012, and the extension of the city manager’s contract is for all intents and purposes lawful, and that the city manager continues to perform his duties as the accounting officer of the municipality.
