Nasty fall raises liability issues

Simangele Manana writes:

I would like to put on record my disgust at the treatment I received from Papachinos and Sevens in Pineslopes after I slipped and fell on the wet tiles outside Papachinos.

After my fall it was only the waiters who showed caring and compassion by offering tissues to wipe the blood that was gushing from my knee wound. When I asked for the manager of Papachinos he was more concerned about liability and responsibility than caring about my injuries. At no point did he even offer first aid assistance, which I believe is mandatory in such cases especially when there is an injury.

All he said was that it was not their responsibility and told me to speak to the people at Sevens before going back into the restaurant. I would hate to believe that other than the concern for liability, he just did not care because of my race and felt that it should be the black waiters who should talk to me as a fellow black person.

When I finally managed to limp into Sevens to speak to the manager, she was also only concerned with liability and responsibility until I insisted that I did not care about these things and just needed medical attention because I was injured. Again in the shop it was the black receptionist who got the first aid box and administered treatment, all the manager offered was a plaster.

I am a human resources manager and I do know what proper procedure is. Papachinos has of yet still not replied to the email detailing this incident which I sent to them, yet I did receive a read receipt when they opened the email.

In response Papachinos Pineslopes writes:

According to our knowledge of the incident Manana was treated by both parties in question and we honestly can’t see where racism comes into this. She was assisted into Sevens by staff of both businesses in question and treatment was administered indoors of the entity. On demanding workman’s compensation, questions arose as to her intentions.

In response Sevens Pineslopes writes:

We told the customer that the premises is part of Papachinos and she could take the matter up with them. There was also absolutely no racial issue at all. She came into the store with a scratch on her knee and was offered a plaster. Our receptionist then fetched our first aid box and assisted her in cleaning the scratch and putting plasters on her knee. We also asked Ms Manana to send us a report from her doctor so that we could refer the matter to Papachinos. There was absolutely no bad treatment from either our side or Papachinos side.
