#SimbaMhere: Sentencing procedure postponed due to probation officer’s report

RANDBURG – Sentencing of the man found guilty for the death of Simba Mhere and Kady-Shay O'Bryan postponed.

Sentencing procedures against Preshalin Naidoo have been postponed to 19 and 20 April.

Naidoo was found guilty in January on two counts of culpable homicide. He was the driver of the vehicle that caused an accident in which TV presenter, Simba Mhere and his friend Kady-Shay O’Bryan died.

Magistrate David Mahango granted the request by the defence to postpone the matter.

Addressing the court, the defence said the probation officer’s report had not yet been finalised and asked for more time to allow the report to be completed.

The state didn’t object.

On 31 January, Magistrate David Mahango delivered judgment and found Preshalin Naidoo guilty on two counts of culpable homicide. The magistrate went through the evidence led by state witnesses.

Mahongo highlighted that evidence led by the vehicle tracking company that had a unit in Naidoo’s car proved that the accused was driving above the speed limit.

The tracking company told the court that between 30 and 31 January they recorded 37 incidents of exceeding the speed limit in said vehicle.

Evidence led in court suggests that the accident occurred just after 5.36am on 31 January 2015. At the time of the accident, the vehicle was travelling at about 166 km/h in a 60 km/h zone. A few minutes prior to that, the vehicle was recorded travelling at about 208km/h.

The accident occurred in the early hours of 31 January 2015 on William Nicol Drive in Fourways.

Mahongo said it was evident that the accused recklessly caused the death of the deceased.
