Two police officers in brutality case may face heavy charges

FOURWAYS – The case against two Douglasdale police officers who allegedly assaulted a man while his friend recorded the incident is still under investigation.

 

This according to Nico Venter of Venters Attorneys, who are representing the victims. “The case is still pending. Both the police and Independent Police Investigative Directorate have confirmed that they are doing a full investigation relating to the charges and we will support the process,” said Venter.

He added that they were in the process of compiling all relevant documentation to hand over to police to aid in their investigations.

According to Garry Hertzberg of Dewey Hertzberg Levy Attorneys, the officers may be charged with one or all of the following charges:

  •  Sexual violation in terms of the sexual offences act in the sense that they assaulted him anally (based on what was said in the video)
  •  It is an assault with the intent to do grievous bodily harm
  •  Crimen injuria (legal term for a willful injury to his dignity)
  •  The incident was very close to being an attempted murder as it would appear, from the video, that the victim was unconscious for a long period of time.

Chairperson of the Douglasdale Community Policing Forum, Jean Berdou urged the public to allow the law to take its course, adding that it was vital that thorough investigations were conducted, including medical examinations.

“The Douglasdale Community Policing Forum is pressing the South African Police Service and the Independent Compliance Directive to speed up their investigations and file formal charges on the two accused police officers,” he said.

Warrant Officer Balan Muthan, head of communications for Douglasdale police reiterated the fact that procedures were in place to ensure that matter was dealt with. “We [Douglasdale police] are not a private entity that do as we please, there are processes that need to be followed,” he concluded.
