UPDATE: Motorist involved in death of Simba Mhere to appear in court

JOBURG - THE motorist who was involved in the accident that killed TV presenter Simba Mhere and his friend will appear in the Randburg Magistrates' Court on 22 June.

UPDATE: 15:45PM – According to a sister publication Yusuf Baba, a senior prosecutor, has confirmed that the case will be heard on the 26 June and not today.

INITIAL REPORT: 12:35pm – Mhere was driving on William Nicol Drive in the early hours of the morning of 31 January, when a vehicle collided with his car at the highway interchange. He was driving with friend Kady Shay O’Bryan and his father.

Mhere and O’Bryan died on the scene.  The motorist appeared in the same court earlier this month on a charge of culpable homicide – an offence which is defined under South African law as the negligent killing of a person.

Culpable homicide is according to Lee Swales’ Law Blog post, an attempt by South African law to punish an individual for acts which are objectively negligent which result in the death of another individual, even though the responsible party may have not subjectively foreseen the fatal outcome of their actions.

The accused is expected to appear in court again in August.
