Conviction for unlicensed firearm and house robbery

On August 16, 2019, at 07:05 the complainant, who is a JMPD officer, was on duty driving an unmarked official vehicle.

The member was parked outside premises in Robertsham, waiting to escort the homeowner to a meeting when he was approached by a white polo with four occupants.

The vehicle blocked his vehicle and two suspects in the polo jumped out and pointed a firearm at him and told him to get out of the car.

The complainant got out of the vehicle and the suspects started demanding his car keys and he tried to draw his firearm but was overpowered by the suspect.

The suspects took his service firearm and the car keys from him. They then got into the official vehicle and drove off. A lookout was given.

On August 28, 2021, at 23:30 Kliptown SAPS was busy with patrols and they searched premises where one suspect was arrested.

In the suspect’s possession was the stolen firearm and official vehicle.

The dockets were combined and given to Sgt Bongani Mthembu to investigate.

All required documentation and statement were obtained.

On September 21 the suspect was found guilty and sentenced as follows:

• Count 1 – 15 years imprisonment

• Count 2 – 10 years imprisonment

• Count 3 – 3 years imprisonment

Count 2 and 3 will run concurrently with count 1 therefore the suspect will spend 15 years in prison. The suspect was also declared unfit to possess a firearm.

Possession of an unlicensed firearm

On November 11, 2019, at 17:20 members from VISPOL followed up information about a person who had an illegal firearm.

The members went to the premises in Turffontein where they met with the suspect’s girlfriend.

The suspect’s girlfriend confirmed that there was a firearm in the house and led the members to the bedroom where they found the firearm.

The members waited for the suspect and placed him under arrest for possession of an unlicensed firearm.

The docket was given to Sgt Bongani Mthembu to investigate. The suspect was found guilty and was sentenced to 12 years imprisonment with six years suspended with conditions.
