Court in Brief

The following cases were recently finalised at the Boksburg/Vosloorus Magistrate's Courts:

Assault
* Joseph Ebele (32) from Jerusalem informal settlement pleaded guilty and was found guilty for assault with intent to do grievous bodily harm and contravening the Immigration Act, on August 22.

The charges emanate from an incident where he assaulted a woman in Boksburg on May 16.

He was sentenced to six months’ imprisonment for count one (assault with the intent to cause grievous bodily harm) and 30 days’ imprisonment for count two (contravention of section 49(1)(a) of the Immigration Act 13 of 2002). He was also declared unfit to possess a firearm.

Magistrate Havenga presided and prosecutor Lingani represented the State.

* Hennie le Roux (34) from Boksburg North was sentenced to 18 months behind bars and declared unfit to possess a firearm for assault.

He pleaded guilty and was found guilty on August 23.

The assault charge stems from an incident where he hit a woman with clenched fists, breaking/spraining her arm on June 13.

Magistrate Havenga presided and prosecutor Lingani represented the State.

Theft
* Shannon Dada (22) from Reiger Park was sentenced to eight months’ imprisonment, wholly suspended for five years for theft.

Dada pleaded guilty and was found guilty on August 22.

He stole a woman’s tablet in Reiger Park on April 4, 2016.

Magistrate Havenga presided and prosecutor Lingani represented the State.

* Lerato Anna Motaung (42) from Boksburg was sentenced to a R300 fine or 30 days in prison, wholly suspended for three years, on August 26 for stealing.

The theft charge stems from an incident where Motaung stole items to the value of R64.51 from Shoprite on April 14.

Magistrate Bacon presided and prosecutor Khwela represented the State.

* Yolande Roets from Brakpan, who was found guilty of 72 counts of theft for stealing over R400 000 from her employer between 2018 and 2020, was sentenced at the Boksburg Magistrate’s Court on August 24.

She pleaded guilty and was found guilty on September 16, last year.

Roets was employed by Mansfield Property Solutions as a portfolio manager of various rental properties.

Between October 2018 and June 2020, she took money from tenants (ranging from R500 to R14 700) that was meant to be payable to Mansfield Properties Solutions.

Counts 1, 3, 21, 28, 34, 35, 36, 37, 38, 39, 41, 42, 45, 46, 47, 48, 49, 50, 51, 52, 67, 69, 70 and 71 are taken together, and Roets is sentenced to three years’ imprisonment, of which two years’ imprisonment is suspended for five years.
Counts 2, 4 ,5, 6, 7, 8, 9, 10, 11, 12, 13, 22, 23, 24, 25, 26, 40, 43, 44, 53, 54, 55, 56 and 68 are taken together, and Roets is sentenced to three years’ imprisonment, of which one year imprisonment is suspended for five years.
Counts 14, 15, 16, 17, 18, 19, 20, 27, 29, 30, 31, 32, 33, 57, 58, 59, 60, 61, 62, 63, 64, 65, 66 and 72 are taken together, and Roets is sentenced to three years’ imprisonment.

Fraud
Neil Tiron Joseph (36) from Benoni was sentenced to a R6 000 fine or six months behind bars on August 22 for fraud. A further 12 months’ imprisonment was imposed but suspended for five years.

He pleaded not guilty to two counts of fraud on September 6, last year, and was found not guilty of count one on April 6 and guilty of count two on August 22.

Joseph did unlawfully, falsely and with the intent to defraud and to the prejudice or potential prejudice of Sanlam Life Insurance and a couple on August 15, 2018.

The couple took out a retirement policy for a premium of R4 000 per month and in his capacity as a financial planner, Joseph assisted the couple and received a commission of R14 970.71. Joseph knew the couple only applied for an educational policy for their child at R600 per month and was therefore not entitled to the commission received.

Trespassing
Thato Meje (24) pleaded guilty and was found guilty of theft and trespassing on August 24.

The charges emanate from an incident where he stole two 10-meter power cables (welding cables) valued at R10 000 from Akura Engineering on June 24.

Magistrate Havenga presided and prosecutor Lingani represented the State.

Possession of explosives
Rafuku Ramaisa (41) from Vosloorus was sentenced to 15 years behind bars on August 22 for being in possession of Viper Boosters.

He was found guilty on June 23.

Ramaisa is guilty of contravening Section 2(1) of the Explosives Act 15 of 2003 read with the provisions of Section 51(2) part 2 Schedule 2 of the Criminal Law Amendment Act 105 of 1997 as amended by Section 33 of Act 62 of 2000 and Section 36 of Act 12 of 2004 and further amended by Act 38 of 2007 is applicable.

Twenty Viper Boosters were found in his car at the Chris Hani Mall on June 15, 2018.
