Every day South Africans face risks, and yet most South Africans have not prepared a legally compliant Last Will and Testament and are nervous to approach Attorneys for assistance. National Wills Week, taking place from 11 to 15 September 2023, affords all South Africans the opportunity to mitigate the pain and difficulty that their passing will cause to friends and family, and to put into place the necessary formalities to ensure that their Estates are finalised in accordance with their wishes. What is National Wills Week?

During National Wills Week all South Africans are encouraged to seek the assistance of Attorneys who are positioned to ensure that your wishes are clearly understood and recorded in a last Will and Testament. Law firms participating in National Wills Week do not charge for the drafting and preparation of basic Wills during National Wills Week, and as such it is the perfect opportunity to finally put a Will in place, or to update an old one. There is no reason not to speak to an Attorney during this National Wills Week, who will provide you with all the assistance you need.

Why use Attorneys for you Will?

Wills are precise legal documents which must comply with a number of formal requirements in terms of the Wills Act No. 7 of 1953 (as amended) as well as ever-developing case law. Attorneys are qualified and have the knowledge and experience to ensure that a valid Will is prepared and can advise you how best to structure your Estate having regard to your specific circumstances.

A properly drafted Will should not only detail the disposition of your assets, but also make provision for more complex arrangements to cater for minor children and dependants who will need security after your passing.

What happens without a Will?

Dying without a Will means your Estate will be resolved in terms of the Intestate Succession Act, Act 81 of 1987, which prescribes a formulaic manner for the devolution of your Estate – taking no account of your wishes or intentions, and often leading to conflict between family members. There will be no control over who is appointed as the Executor/Executrix of your Estate and the administration of the Estate shall take far longer. Finally, if there are any minor children due to inherit from a person who has died intestate (without a Will), their inheritance will fall into the Guardians Fund which is administered by the Master of the High Court, thereby creating further administrative hurdles and potential practical difficulties for those minors. These issues can be avoided by ensuring that your wishes are recorded in a properly drafted Last Will and Testament.
