Court in Brief

The following cases were recently finalised in the Boksburg Magistrate's Court:

Assault
On March 17, Tebogo Nkata (43) from Vosloorus was sentenced to 10 years in prison for assault with the intent to cause grievous bodily harm. The charge stems from an incident during which Nkata hit a seven-yearold boy on the head with the wooden handle of a mop in Vosloorus on August 30, last year.

He pleaded guilty, was found guilty and sentenced on March 17.

“I admit that on that day at about 14:00 I was sleeping when I heard knocking at my door. When I opened the door no one was outside. Shortly thereafter, there was another knock. When I opened the door I saw the complainant and his friends running from my yard. I was angry as it appeared that they were playing games and disturbing me. I chased them into a neighbour’s yard and confronted them about the incident and they denied it. I became angry because they did not apologise. I took a mop, which I found in the yard, and hit the complainant on his head,” read a part of Nkata’s plea.

The boy sustained a large laceration to his head.

Nkata has at least nine previous convictions for assault and malicious damage to property.

Theft of motor vehicle
On March 14, Zamokuhle Perfect Zulu was sentenced to nine years’ imprisonment on a charge of theft of a motor vehicle.

He pleaded not guilty on March 2 but was found guilty on

March 14. On December 13, 2019, Zulu stole a Ford Ranger in the vicinity of Spruitview.

Rape
On March 16, a 52-year-old man from Vosloorus was sentenced to 10 years in prison for rape. George Dladla pleaded guilty and was also found guilty on March 16.

 On March 4, last year, Dladla unlawfully and intentionally committed an act of sexual penetration wita woman.

Trespassing
On March 16, Fanyane Lungane (68) was sentenced to two years’ imprisonment for

trespassing after not complying with an eviction order.

Lungane had a bond on a house in Vosloorus, which he failed to pay. A judgement was attained against him by Nedbank but still he failed to pay and so the property was sold on auction. Despite the purchase of the property by a new owner and registration in her name, Lungane refused to move and an eviction order was applied for. He was evicted from the premises by the Sheriff of the Court. Despite the eviction, Lungane moved back in before the owner could return and refused to vacate.

A criminal docket was registered by the owner for trespassing and he was arrested. He thereafter tried all means to avoid a prosecution. The High Court was approached for a rescission of judgement for the eviction order which was unsuccessful.

Representations to the regional and national Director of Public Prosecutions to have prosecution declined were unsuccessful. The trial commenced in the Regional Court Vosloorus where Lungane pleaded not guilty on February 22 but was found guilty and sentenced on March 16.
