Court to subpoena witness from criminal records bureau

A witness from the criminal records bureau will be summoned to the Boksburg Magistrate's Court to give evidence regarding Mamogobo’s previous convictions

The sentencing proceedings against a 30-year-old man who assaulted his mother (58) and police officers last year were postponed in the Boksburg Magistrate’s Court on February 5.

Emmanual Mamogobo was found guilty on January 27 of assault with the intent to cause grievous bodily harm after assaulting his mother in January, last year, and guilty of assault for an attack on police officers while resisting arrest.

Sentencing was postponed after Mamogobo refused to sign the SAP 69 document after the state prosecutor read his previous convictions out in court, which include common assault, malicious damage to property and housebreaking.

Mamogobo told the court that he cannot sign the document because he had “allegedly” been cleared of all these convictions.

He explained to the court that in 2019 his previous convictions were cancelled in Pretoria, subsequently making him a first-time offender.

When magistrate Cecil Kruger asked if he admits to having committed these crimes Mamogobo answered “yes” but said he might have committed six or more crimes.

At that point he became agitated and started raising his voice to the magistrate.

The magistrate adjourned the court proceedings for a few minutes to allow the accused to calm down.

After the adjournment, the magistrate said the court didn’t have sufficient information regarding the accused’s previous convictions and said he won’t proceed if the number of convictions were unclear.

He told the state prosecutor to call a witness from the Criminal Records Bureau to testify about Mamogobo’s previous convictions before he proceeds with the sentencing, which was then postponed to February 26.
