“Abusive” son who allegedly stabbed his mother, appears in court

The Magistrate, Cecil Kruger warned the accused Mamogobo to stop wasting the court’s time

Emmanuel Mamogobo is accused of abusing his mother, and he made his latest court appearance on December 1 at the Boksburg Magistrates Court.

The victim (his 58-year-old mother) took to the stand and explained to the court how her son assaulted her. Mamogobo is facing a charge of assault with the intent to cause grievous bodily harm for allegedly assaulting his mother in January.

The accused is facing another assault charge for attacking police officers while he was resisting arrest in February.

The mother, Nthabiseng Hlankana, told the court that the assault happened after an argument about cooking. The son wanted to cook porridge, but his mother told him that it was not ideal to do so as she had already started cooking rice for them (family).

The son allegedly made offensive remarks against his mother and swearing at her. He further told the mother that would take all the money from the tenants. The mother said it was just after she asked him if the tenants would give him the money when he started to attack her with a screwdriver. He allegedly stabbed her in the forehead and hit her in the neck before she fell to the ground.

“I just felt blood gushing out of my forehead and he kept kicking me while I was down. He then exited the house, and when I got up I was very dizzy.” Neighbours called an ambulance and I was admitted at Tambo Memorial Hospital, where she received medical attention.

During the trial, Magistrate Cecil Kruger asked Mamogobo if he received the contents of the disclosure, and his answer was no, saying he only received the charge sheet from his lawyer during his previous appearance.

While the magistrate was asking him why he wasn’t in possession of the other documents he then asked to be excused so that he can go to the bathroom. Court had to adjourned for a few minutes until he came back.

The magistrate said he was failing to understand why Mamogobo didn’t have the documents as the case had been ongoing for months with various defense lawyers on record until recently when he wanted to represent himself.

“You are delaying your case and because you are not in possession of the documents we can’t proceed because the court doesn’t want your rights to be infringed,” Kruger said.

Kruger further asked him if he was ready to represent himself, and he again said he didn’t have time to prepare for the case as he was sharing a cell with more than 60 people.

The magistrate then asked if the state could furnish him with the contents of the disclosure. The matter was then postponed to December 3, but the four witnesses were excused from coming to court until they get a date for the continuation of the trial.

Kruger warned Mamogobo to stop wasting the court’s time and that he should make up his mind whether he still wants to represent himself or needs a lawyer.

“There are other people who must appear in court and you are busy wasting their time, and that is unacceptable.”
