MEC being sued by Vosloorus mom who went home with wrong baby

The attorney for a Vosloorus mother who went home with the wrong baby from the Tambo Memorial Hospital in August 2010, has confirmed the mother has instituted damages against the former Gauteng MEC for Health, Qedani Mahlangu, for this massive healthcare blunder

The attorney said the other mother involved in this bizarre case has also issued a summons against the MEC, through her own legal representative.

It is alleged that a nurse in the maternity ward at the hospital switched the name tags of the babies, which led to the debacle.

The babies involved are a boy and a girl. The Vosloorus mother gave birth to a girl and is now raising the boy.

“We expect the trial date to be set for next year,” said Henk Strydom, of Strydom Attorneys in Germiston.

This legal action follows a Gauteng High Court ruling on November 16, 2015, which ordered the children remain with the parents who raised them.

The children have since been legally adopted by the parents who raised them.

Strydom said: “My client is suing the MEC for pain and suffering, loss of support for the child, medical and future medical expenses and counselling support – among other things,” Strydom said.

The Vosloorus mother was totally unaware she was raising a baby who was not her own until 2014 when she took legal action against the father for outstanding maintenance money.

The father denied he was the child’s father and requested a paternity test. The test indicated the couple were not the child’s biological parents.

“We issued a summons in 2016 against the Gauteng MEC for Health and are awaiting a trial date, which we expect will be set for next year,” said Strydom.
