Prepare your will this September

Malherbe Rigg & Ranwell Inc (MRR), in association with the Law Society of South Africa, will, from September 12, host the annual Wills Week.

This will allow members of the community to have their last will and testament expertly drafted, free of charge.

According to Jennifer Venter, of MRR, Wills Week not only offers members of the community the opportunity to set up a will, but also assists in abolishing any misinformation regarding wills and the process involved.

“We invite the community to take part in this initiative, which will ensure that their last wishes are fulfilled, thus ensuring that their loved ones are provided for after their passing,” she said.

“There are numerous institutions which are able to draft a will and basic testamentary documents are available from most stationers.

“What many people do not realise is that a will set up in this manner or by a person who lacks legal expertise to ensure that the requirements of the law are met and that the wording is correct, could ultimately lead to a will being declared null and void or a will that does not correctly reflect the intention of the testator.

“That is why MRR continues to take part in this programme, to ensure that each and every person, regardless of their financial position, is able to have access to a well drafted will.”

Why is it so important to have a will?

* A will allows you to allocate your assets (home, vehicle, policies, etc.) to members of your family, friends or organisations of your choice.

* A death without a valid will could lead to unhappiness amongst surviving family members, unnecessary costs and could delay the winding-up of the estate.

* A will written by a person who lacks knowledge regarding the process and legal terminology could lead to your will being misinterpreted.

* Attorneys have the knowledge and infrastructure to assist you in drafting a clear and valid will and can answer any related questions following your death, as well as assist your loved ones to register the estate and to ensure that it is wrapped up as soon as possible and with as little effort as possible.

What do you need to draft a will?

All that is needed to draft a valid will is the names of the persons you would like to benefit from your estate and who will be named as guardians of any minor children. The attorney will then be able to assist in the drafting of the will and will ensure that the legal formalities are complied with.

Drawing a will is a quick, painless exercise.

Preparing to die

It may seem like a morbid thought, but in order to ensure that your estate is administered as quickly as possible following your death, it is of utmost importance that you ensure that your family and the appointed executor have access to all your financial records and dealings.

Venter, therefore, suggests that all the following documents are filed together:

* Copy of your will, together with details of where the original is kept;

* Insurance policy documentation;

* Documentation relating to assets such as investments, shares, properties, vehicles, etc.

* Funeral cover documentation;

* All recent account statements such as doctors, clothing accounts, furniture and credit cards;

* Income tax information; and

* Pension/employment details.

Setting up a will is your way of ensuring that your loved ones are well taken care of during their time of grief.
