Court hands down sentences for theft, violating protection orders

The following cases were heard in the Boksburg Magistrate's Court:

* Joseph Kubheka (33) was convicted for theft on January 15.

The accused pleaded guilty for theft and the court also found him guilty as charged.

Kubheka was charged for robbery with aggravating circumstances after he robbed Caswell Mokhetsi of his cellphone worth R600 using a firearm.

He has four previous convictions of theft in 2003, two counts of robbery in 2005, housebreaking and theft in 2008 and receiving stolen property in 2012.

He has been sentenced to 15 years in prison.

Magistrate Sijren Harichand presided over the case and prosecutor Nkosazana Tyeku represented the state.

* Siphumelele Tombo (26) was convicted for theft on February 1.

This is after he stole six chocolate slabs from Pick n Pay in December last year.

He has two previous convictions of assault with intention to cause grievous bodily harm in 2011 and housebreaking with the intention to steal and theft in 2015.

The court sentenced him to three years in prison and ordered that he serve an effective two years before he is considered for parole.

The court also ordered that the sentences should not run concurrently with any other sentence he was serving.

Tombo was sentenced to 36 months in prison, of which 12 were suspended for five years, in April 2015.

Magistrate Jurg Viviers presided over the case and prosecutor Themba Maluleka represented the state.

* Motsamai Makgaledisa (42) of Vosloorus was convicted for violation of a protection order on February 2.

Epharaim Makgaladisa sought a protection order against Motsamai in 2011, prohibiting and directing him not to damage his property.

But on October 18 last year, Motsamai nonetheless entered Ephraim’s property and damaged a house window worth R180.

He was consequently arrested and sentenced to 24 months of correctional supervision.

He has four previous convictions of assault in 2013, 2012, and 2006, and malicious damage to property in 2006.

Magistrate Jurg Viviers presided over the case and prosecutor Themba Maluleka represented the state.

* Maria Belinda Phiri (20), a Zimbabwean national, was convicted of theft on February 2.

She pleaded guilty and was found guilty as charged. This is after she stole a tablet and perfume worth R5 000 from Protea Shabangu.

She was sentenced to R5 000 or 15 months in prison. She has no previous convictions.

* Moalusi Lucas (45) of Vosloorus was convicted for violating a protection order on February 2.

He pleaded guilty and was found guilty as charged.

Salome Mashaku sought a protection order against Lucas in June 2008, prohibiting and directing him not to come near or assault the complainant.

But in October last year, Lucas violated the protection order when he kicked and severely beat up Mashaku with a steel rod.

He has a previous conviction of assault in 2000.

He was sentenced to 18 months correctional supervision.

* Correction: In last week’s court briefs, we reported that Leon Reddy was sentenced to two years in prison for stealing R100 000 from Sunward Park High School. Reddy was, in fact, jailed for five years.
