East Rand Mall Galaxy robber sentenced

Neville Orett Mustard (40) of Benoni was convicted of robbery with aggravating circumstances when he appeared in the Boksburg Magistrates Court.

On April 2, he intentionally and unlawfully assaulted Duduzile Nonjinge and, with force and using a firearm, took rings worth R56 996 and R11 000 cash from Galaxy in the East Rand Mall.

Mustard admitted that, on the day in question, he was tempted and then entered Galaxy and took out a toy gun and pointed the victim and demanded cash and jewellery.

He was subsequently arrested on April 9 and he has been on trial ever since.

According to the Boksburg North SAPS’s communication officer, Lieut Juanita Coetzer, crime intelligence officer Capt Garon Sage and Det WO Gideon O’Neill arrested the accused in the Benoni Agricultural Holdings.

“They also confiscated a gas pistol,” said Coetzer.

“They found one set of rings on the suspect’s fiancé’s finger and the others were found at a jeweller in Primrose, where he sold them, together with an older engagement ring, for R1 000.”

He pleaded guilty in court, was found guilty as charged and sentenced to 15 years in prison on October 9.

Mustard has three previous convictions: a housebreaking and theft in 1992, use of motor vehicle without owner’s consent in 2000, and two counts of fraud in 1999.

Magistrate Abel Shilubane presided and prosecutor Maria Olivier represented the state.

Oscar Joga (42), of Jubilee Road, was convicted of theft on October 12.

Joga stole a chicken braaipack, polony and cheese, all valued at R156.79, from Pick n Pay on July 2.

He pleaded guilty and the court found him guilty as charged and sentenced him to a fine of R1 500 fine or three months in jail.

His sentence was wholly suspended for five years.

He has a conviction for assault dating back to 1996.

Magistrate Molefe Ratlau presided and prosecutor India Roos represented the state.

Simphiwe Mtshali (19), of Soweto, was convicted of housebreaking with intent to steal, and theft.

The accused broke broke into the premises of Douglas Vincent and stole a DVD, earphones, computer monitor, cellphone, two speakers and a bag, on April 10, 2012.

He has two previous convictions for housebreaking and theft, one in 2010 and another in December 2012.

He was sentenced to five years in prison on October 12, following a guilty plea.

Magistrate Abel Shilubane presided and prosecutor Maria Olivier represented the state.

Eugene Africa (23), of Windmill Park, and Tony Green (23), of Villa Lisa, were convicted of possession of stolen property.

The two men were charged with possession stolen property after they were found in possession of a stolen Toyota Corolla in Windmill Park, on January 23.

Africa has two previous convictions, for housebreaking and theft, in 2008, and assault in 2011.

Green has a previous conviction for theft, in 2012.

They were each sentenced to five years in prison, on October 13, following a guilty plea.

A third co-accused, Vernon Williams (18), had the charges against him withdrawn.

Magistrate Sijren Harichand presided and prosecutor Nokosazana Tyeku represented the state.
