Court briefs: 35 year sentence each for three murderers

The following cases were heard in the Boksburg Magistrate Court:

* Thabo Paul Mashiloane (31), Sibusiso Maxwell Nqukwane (19) and Jabulani Elias Ndlovu (37), all of Windmill Park, were each sentenced to 35 years in prison for murder and car theft.

The three, together with their fourth accomplice, Andrew Kgwala Tshoane (27), who has since been acquitted, were accused of intentionally killing Dennis Sibusiso Sithole, by shooting him on December 19, 2010, in Dawn Park.

The four faced another charge of robbery with aggravating circumstances, after they took the deceased’s Hyundai vehicle by force.

They faced an additional charged of possession of an illegal firearm – a 9mm automatic pistol.

All the accused pleaded not guilty to all the charges.

Tshoane was acquitted on all the charges, while Mashiloane and Ndlovu were discharged on the charge of possession of an illegal firearm.

All three were found guilty of murder and robbery with aggravating circumstances and each received a maximum sentence of 25 years for murder and 10 years for the second charge.

The sentences will run concurrently, meaning they will serve an effective 25 years in prison.

Mashiloane has a previous conviction for assault and Ndlovu was previously convicted of house breaking.

Magistrate Colberc Ramufhufhi presided and prosecutor Jabu Motha represented the state.

* Ricardia Tommy (25), of Reiger Park, pleaded guilty to and was convicted on a charge of malicious damage to property, on June 30.

On March 21, Tommy unlawfully and intentionally damaged a State date stamp valued at R800.

She was at the police station with her sister, following a domestic dispute, and after exchanging words with her sister, she angrily grabbed the stamp and threw it at her.

The stamp hit the wall after missing its intended target and was damaged.

Tommy was sentenced to a fine of R3 000 or six months in jail, wholly suspended for five years.

Magisatrate Molefe Ratlau presided and prosecutor Palesa Setshedi represented the state.

* Bheki Mabunda (28), of Katlehong, pleaded not guilty, but was found guilty and convicted on a charge of theft, on June 6.

Mabunda stole groceries worth R2 042.50 from a Boxer store, on May 22.

He has no previous convictions and the court sentenced him to a fine of R5 000 or 15 months in jail, wholly suspended for five years.

Magistrate Jurg Viviers presided and prosecutor Themba Maluleke represented the state.

* Joseph Matsobane (40) pleaded not guilty to murder on July 6.

The court, however, found him guilty of killing Mansy Julia Lekgoathi, by hitting her with a blunt object, stabbing and strangling her, on September 16, 2012.

She died due to head injuries, bleeding on the side of the brain and multiple lacerations, among other injuries.

Matsobane has no previous convictions and the court sentenced him to an effective 16 years in prison.
