Thief with seven convictions again in hot water

The following cases were heard in the Boksburg Magistrate's Court:

* Chicco Mashaba (42), of Cinderella Hostel, pleaded guilty and was found guilty of theft, on March 26. The court sentenced him on May 5.

Mashaba, a Mozambican national, stole six body lotions, two roll-on bottles and two Nivea moisturising creams from an unidentified store. Mashaba has seven previous convictions for theft and one for assault.

He was sentenced to two years in prison and was ruled unfit to possess a firearm.

Magistrate Hans Havenga presided and prosecutor Phelisa Setshedi represented the state.

* Armindo Sithole and Rofilo Manual Tirane were both found guilty of possession of housebreaking implements, on May 6.

The two men were arrested in Odendaal Street after being found in possession of a screwdriver, player, site cutters and knife, in the early hours of the morning of December 22, 2014.

Police believed there was a reasonable suspicion that the tools had been used or were intended to be used to commit a housebreaking, or to gain unlawful entry into a motor vehicle.

The accused were unable to give a satisfactory account of the items they possessed and could also not explain what they were doing in the area at that time of the night.

Sithole has three previous convictions for theft and he was sentenced to 18 months in prison. Tirane has no previous conviction and was sentenced to six months in prison.

Magistrate Emmanuel Magampa presided over the case and prosecutor Angeline Mooiman represented the state.

* Steven Gilcrest, of Ramaphosa informal settlement, pleaded not guilty to a charge of housebreaking with intent to steal and theft, on April 29.

However, on May 11, the court found him guilty of theft, acquitted him on the housebreaking charge and sentenced him to 18 months in prison. He was previously convicted of assault and theft.

Magistrate Molefe Ratlau presided over the case and prosecutor Phelisa Setshedi represented the state.
