Attempted murderer gets 20 years – court news

The following cases were heard in the Boksburg Magistrates Court:

* Elvis Ubisi (36) and Andries Msinga (38), from Daveyton, appeared in court on a charge of escaping lawful custody.

They pleaded not-guilty on January 16, 2013, were found guilty and sentenced on September 25, to five years imprisonment of which two years are suspended for five years.

On December 3, 2011, the men escaped from police custody after they were arrested, but before they were placed in a holding cell.

Magistrate Abel Shilubane presided over the matter, and Maria Olivier appeared on behalf of the State.

* Zitho Makamu (27), from Windmill Park, and Francisco Thobela (27), from Rondebult, appeared in court on two charges of house-breaking and aggravated robbery and two charges of attempted murder.

The case against Thobela was withdrawn.

Makama pleaded not-guilty on April 10, was found guilty on one charge of house break-in and one charge of attempted murder. He was sentenced on September 25, to 20 years imprisonment.

On March 22, 2013, the accused broke into the home of Johannes Machadibane and stole a TV, sound system, home theatre and DSTV decoder, to the value of R17 000.

He attempted to murder the complainant by shooting him.

The accused was connected through DNA and ballistics.

Magistrate Sijren Harichand presided over the matter, and Leon Naude appeared on behalf of the State.

* Simphiwe Ngema (23), from Vosloorus, appeared in court on a charge of assault with the intent to cause grievous bodily harm.

He pleaded guilty and was found guilty on August 25, and sentenced on September 30, to R2 000 or six months imprisonment.

On July 26, the accused assaulted Duduzela Nthethwa by hitting her with his fists.

Magistrate Jurg Viviers presided over the matter, and Themba Maluleke appeared on behalf of the State.

*Dumisani Matika (31) appeared in court on a charge of theft.

He pleaded guilty and was found guilty on August 25, and sentenced on September 29, to R3 000 or nine months imprisonment.

On August 20, the accused stole a Sony digital camera from Witness Moraki.
