Court brief: Young hijacker sentenced to five years

The following cases were heard in the Boksburg Magistrates Court:

* Andile Mahlangu (19), of Windmill Park, was convicted of attempted robbery with aggravating circumstances, on September 9.

On April 4, 2015, Mahlangu attempted to rob Clive Charles Retief of his car and his wife’s handbag, at gunpoint.

However, the tables turned against him when Retief pulled out his own firearm and fired at Mahlangu, hitting him six times in both his legs.

He sustained six bullet wounds and was admitted to hospital under police guard.

He stood trial following his discharge from hospital.

He pleaded not guilty to the charge, but the court found him guilty as charged.

The accused also smelt of alcohol at the time.

He had no previous convictions and was sentenced to five years in prison, of which 18 months were suspended for five years.

Magistrate Abel Shilubane presided and prosecutor Maria Olivier represented the state.

* Alfred Vusi Sithole (40), of Lindelani, was convicted of attempted murder on September 2.

On May 14, the accused poured petrol on Thandeka Valencia and set her alight.

She escaped with minor injuries.

He pleaded guilty and was also found guilty as charged.

The accused, who had no previous convictions, was sentenced to 10 years in prison, wholly suspended for five years.

Magistrate Suren Harichand presided and prosecutor Nkosazana Tyeku represented the state.

* Xolani Koti (29), of Vosloorus, was convicted of theft on September 5.

He pleaded guilty to stealing R850 cash from Patricia Tshangase, on April 28, and the court also found him guilty as charged, on July 25.

The accused, who had no previous convictions, was sentenced to 18 months correctional supervision, with the following conditions:

-That he does 16 hours of community work.

-He retains his employment.

-He takes part in a community development or treatment programme.

-He participates in mediation between offender and victim.

-He does not use alcohol for the duration of the sentence.

-He does not commit any criminal offence.

Magistrate Jurg Viviers presided and prosecutor Themba Maluleke represented the state.

* Lehlogonolo Moloko (27), of Katlehong, was convicted of theft on September 6.

The accused pleaded guilty and was also found guilty as charged, on July 26.

This is after he stole a top-line spanner from Builders Warehouse on June 21.

He was sentenced to three years in jail.

Magistrate Jurg Viviers presided and prosecutor Themba Maluleke represented the state.

* Victor Magqo (32), address unknown, was convicted of housebreaking with the intention to steal, and theft, on September 8.

The accused broke into and entered plot 127, in Mapleton, belonging to Armando Balanco.

The victim told the court that the incident affected him emotionally and physically.

The suspect, who pleaded guilty, was sentenced to 18 months in prison.

Magistrate Jurg Viviers presided and prosecutor Themba Maluleke represented the state.

* Goodman Sithole (29), of Tembisa, was convicted of theft on September 12.

The accused was caught on camera stealing two laptops, valued at R22 439.05, from RTT Intelligence Logistics, or Mr Jerry Selota, on July 14.

However, the accused pleaded not guilty, regardless of the overwhelming evidence against him.

The court found him guilty and ordered him to pay a fine of R3 000 or spend six months in prison.

Magistrate Emmanuel Magampa presided and prosecutor Angeline Mooiman represented the state.

* Piet Pieterson (57), of Reiger Park, was convicted of contravening a court order on September 9.

On January 22, the court issued an order prohibiting him from assaulting, threatening, or swearing at an applicant.

He was further restricted from entering the applicant’s property.

However, on July 6, the accused contravened the order by assaulting the applicant, choking her and throwing her to the ground.

He pleaded not guilty, but the court found him guilty and sentenced him to 12 months in prison.

Magistrate Ryan van Haarte presided and prosecutor Tashnee Ramchuran represented the state.
