According to News24, “Masipa struck the application off the role, arguing that both sides had an opportunity to make representations during the appeal hearing, and she cannot review her own ruling.”
The news comes after Masipa had granted the State’s application to appeal Pistorius’ culpable homicide conviction, but dismissed its application to appeal his five-year jail sentence.
State Prosecutor Gerrie Nel was quoted as saying, “This matter should not be granted,” arguing that this would spark appeal after appeal.
