According to reports, a representative of Zamokuhle Mbatha said Mbatha’s lawyer has given his advice in terms of the next course of action.
Shortly after Mbatha’s arrest last month, the police declared their breakthrough in the murder of Meyiwa, adding that they had the right suspect in the case.
However, about two weeks later the court dropped all charges against Mbatha.
Speaking to reporters outside the Boksburg Magistrate’s Court, shortly after the case against Mbatha was withdrawn, National Prosecuting Authority spokesman Nathi Mncube said insufficient evidence, discrepancies, inconsistencies and contradiction in witness statements prompted the court to withdraw the charges.
Mncube revealed that only two out of seven witnesses at the identity parade had pointed out Mbatha as a suspect in Meyiwa’s murder.
The police said the withdrawing of charges against Mbatha did not necessarily mean he cannot be re-arrested and charged again.
Gauteng police spokesman Brig Neville Malila reportedly said should police gather enough evidence, Mbatha could still be re-arrested and charged at a later stage.
Earlier in court, prosecutor Gertrude Market told magistrate Daniel Thulare that there were new developments in the case and that the police were following up on leads.
Meyiwa was shot dead during an armed robbery in Vosloorus last month at the family home of his girlfriend, Kelly Khumalo.
